Greenleaf Probate Code Revisions Approved by
Senate
HARRISBURG -- The
Senate unanimously approved Senate Bill 660, a measure offered by Sen. Stewart
J. Greenleaf amending the Probate Code to incorporate the Uniform Trust Code and
to provide modifications to the law with regard to trusts.
Greenleaf said the goal of
the legislation is to provide an organized and comprehensive codification to
make it easier for judges and attorneys to access the law. He said that it
would also assist trustees who do business in more than one state to have a more
uniform framework to comply with the law.
“Most importantly,” Greenleaf
said, “this bill would enable beneficiaries of Pennsylvania trusts to know when
and how to enforce their rights." The proposed changes encourage, and in some
cases, require a trustee to communicate with a trust's beneficiaries.
The legislation is based on
the recommendations of the Joint State Government Commission's Advisory
Committee on Decedents' Estates Laws. The advisory committee borrowed heavily
in the drafting process from the Uniform Trust Code proposed by the National
Conference of Commissioners of Uniform State Laws. So far, nine states and the
District of Columbia have enacted the uniform law.
